“კომუნიკაციების კომისიის მიერ “კავკასუს ონლაინის” 49%-იანი წილის მფლობელისთვის, კომპანია Neqsol Holding-ისთვის მიცემული ულტიმატუმით, კომპანიას ვადა 20 სექტემბრამდე აქვს, რათა კომპანიის წილების შეძენის გარიგება გააუქმოს,”- ნათქვამია სტატიაში.
საუბარია $61-მილიონიან გარიგებაზე, რომელიც 2019 წელს შედგა და რომლის შესახებაც კომუნიკაციების კომისია აცხადებს, რომ ტრანზაქცია მისი ნებართვის გარეშე განხორციელდა.
ივლისის შუა რიცხვებში საქართველოს პარლამენტმა დაჩქარებული წესით მიიღო კანონმდებლობა, რომელიც კომუნიკაციების კომისიას ახალ უფლებამოსილებებს ანიჭებს და მას სადავო ტრანზაქციის მიმართ ახალი სანქციების გამოყენების შესაძლებლობას აძლევს. შედეგად, კომისიამ კომპანიას ახალი მოთხოვნა განუსაზღვრა, NEQSOL-მა შეთანხმება 20 სექტემბრამდე უნდა გააუქმოს ან „სპეციალური მმართველი“ დაინიშნება კომპანიის სამართავად“, – წერს გამოცემა.
კომუნიკაციების კომისია Capacity Media-სთან საუბარში აცხადებს, რომ მათ გააჩნიათ რეგულარული პროცედურა, რომლის ფარგლებშიც ყველა ავტორიზებული პირის მესაკუთრეთა სია მოწმდმდება. “11 თვის წინ, სწორედ ასეთი შემოწმების დროს, კომისიამ აღმოაჩინა, რომ “კავკასუს ონლაინის” ბენეფიციარ მესაკუთრეთა რიგებში ცვლილება იყო და კომპანიის 49%-იანი წილის გასხვისება მათი ოფიციალური თანხმობის გარეშე მოხდა,”- ნათქვამია სტატიაში.
კომუნიკაციების კომისიამ 20 აგვისტოს სხდომაზე “კავკასუს ონლაინს” 270,000 ლარის მოცულობის ჯარიმა დააკისრა. ამ ჯარიმამდე კომპანიას თავდაპირველად 30,000 ლარის, შემდგომ 90,000 ლარის, 270,000 ლარის მოცულობის სამი ჯარიმა დააკისრა.
თავისმხრივ, NEQSOL Holding-ი აღნიშნავს საქართველოს მაშინდელი ხელისუფლება ისევე როგორც, კომუნიკაციების კომისია და სახელმწიფო უსაფრთხოების სამსახური გარიგების საქმის კურსში იყო და არსებობდა შესაბამისი თანხმობაც იმის თაობაზე, რომ “კავკასუსის” წილი შეეძინათ.
პარალელურად საქართველოში მიმდინარე დავისა NEQSOL Holding-ი ახალი ციფრული დერეფანის პროექტის განხორციელებაზე მუშაობს, რომელიც ევროპას ცენტრალური აზიის ქვეყნებთან დააკავშირებს. Capacity Media-სთან საუბარში კომპანიის სტრატეგიული განვითარების ხელმძღვანელი თემურ თაგიევი ამბობს, რომ “კავკასუსის” წილის შეძენა სწორედ ამ პროექტის განხორციელებისთვის მოხდა.
“NEQSOL-ის პოზიცია არ შეიცვლება“, – განუცხადეს Capacity Media-ს კომპანიაში.
“ჩვენ გაკვირვებული და იმედგაცრუებული ვართ საქართველოს კომუნიკაციების ეროვნული კომისიის მცდელობების გამო, რომ დაბლოკონ ეს პროექტი, რითიც საქართველოს ეკონომიკა შეჩერდება“, – განაცხადა NEQSOL-ის წარმომადგენელმა თეიმურ თაგიევმა, – “ვიმედოვნებთ, რომ საქართველოს მთავრობა არ ჩაერევა და უზრუნველყოფს კანონის უზენაესობას და იმას, რომ ჩვენი ინვესტიცია იყოს დაცული“, – განაცხადა თემურ თაგიევმა.
NEQSOL-თან მიმდინარე დავის პარალელურად, საქართველოს პარლამენტმა დაჩქარებული წესით მიიღო კანონი, რომლითაც კომუნიკაციების კომისიის უფლებამოსილებები გაფართოვდა მას კომპანიებში სპეციალური მმართველის დანიშვნის უფლება მიეცა. “თავად სპეციალურ მმართველს კი უფლება აქვს დანიშნოს და გაათავისუფლოს დირექტოთა საბჭოს წევრები, გაწყვიტოს კავშირები კონტრაქტორებთან, შეაჩეროს ან შეზღუდოს მოგების განაწილების პროცესი, ასევე შეასრულოს სხვა ფუნქციები კომპანიის მმართველობაში,”- ნათქვამია სტატიაში.
კომუნიკაციების ეროვნული კომისია Capacity Media-სთვის გაგზავნილ განმარტებაში აცხადებს, რომ “კავკასუს ონლაინს” კომისიის წინაშე ჰქონდა ვალდებულება წინასწარ შეეთანხმებინა გარიგებები, რომლებიც მისი მფლობელების ცვლილებას უკავშირდებოდა, რისი ვალდებულებაც კომპანიას განესაზღვრა მაშინ, როდესაც “კავკასუს ონლაინმა” მისი ოპტიკურ-ბოჭკოვანი ინტერნეტის საცალო ქსელის “მაგთისთვის” მიყიდვაზე მიიღო ნებართვა.
Capacity Media აღნიშნავს, რომ ის NEQSOL Holding-სა და კომუნიკაციების კომისიას შორის მიმდინარე დავას დაუბრუნდება მას შემდეგ, რაც კომისიის მიერ კომპანიისთვის 20 სექტემბრამდე მიცემული ვადა ამოიწურება.
