Farhad Azima, an aviation\u00a0executive\u00a0and citizen of the United States of America\u00a0<\/strong>has applied to the Georgian Supreme Court\u00a0for the recognition of\u00a0an\u00a0approximately\u00a0\u00a38.9\u00a0million\u00a0order of the High Court of Justice of England and Wales against\u00a0the\u00a0Ras Al Khaimah<\/strong>\u00a0<\/strong>sovereign wealth fund,\u00a0Ras Al Khaimah Investment Authority (“RAKIA\u201d)<\/strong>. RAKIA is the owner of a Georgian subsidiary, Ras Al Khaimah Investment Authority Georgia LLC (\u201cRAKIA Georgia<\/strong>\u201d) which, until last week, owned the Sheraton Grand Tbilisi Metechi Palace Hotel<\/a>, managed by the Marriott Group.<\/p>\n

Mr Azima has been seeking to prevent RAKIA from disposing of its Georgian assets, including the Sheraton Grand Tbilisi, but last week RAKIA transferred this to Tbilisi Hotels Holding LLC for USD 44.8 million, in an apparent effort to avoid enforcement action. However, directors of the new entity are all also directors of RAKIA Georgia and Senior Executives at RAK Hospitality Holding LLC, including Alison Jayne Grinnell their Chief Executive Officer<\/a>, Stefan Johann Hanekom their Chief Financial Officer<\/a>, and Donald William Bremner their Chief Operating Officer<\/a>.<\/p>\n

Mr Azima commented:<\/p>\n

\u201cIt is disgraceful that Ras Al Khaimah sovereign wealth fund\u00a0is unwilling to pay its English Court ordered debts. It has now been almost eight months since they owed me substantial sums and I am left with no option but to enforce the debt.\u00a0When Ras Al Khaimah sovereign wealth fund has no respect for the rule of law, that casts a shadow over the investment climate in the Emirate. Switching ownership is a crude attempt to avoid enforcement, which will not succeed. We warn any third parties against assisting RAKIA in the dissipation of assets.\u201d<\/p>\n

In 2016, RAKIA sued\u00a0Mr Azima\u00a0in the English High Court, relying\u00a0on\u00a0certain documents obtained from\u00a030GB of\u00a0private and confidential\u00a0data\u00a0which had been\u00a0hacked from Mr Azima\u00a0and published online.\u00a0Mr Azima counterclaimed\u00a0that RAKIA was responsible for the hacking and publication of his data.<\/p>\n

Over the next four years, evidence\u00a0came to light\u00a0that RAKIA and its advisors\u00a0had\u00a0engaged private investigators to hack Mr. Azima, report on the contents of his data\u00a0and release\u00a0it\u00a0online. One investigator admitted to the hacking and, with others, partaking in a conspiracy to cover it up: witnesses were suborned,\u00a0disclosure was\u00a0deliberately\u00a0withheld, misleading evidence was rehearsed, including at a \u2018perjury school\u2019 run by a Dechert LLP lawyer at a luxury Swiss hotel, and false evidence was\u00a0submitted\u00a0to the English High Court.<\/p>\n

In June 2022, in the light of the new evidence, RAKIA wrote to the English High Court stating that it would play no further part in the proceedings. RAKIA confirmed that it would honour any judgment entered against it.<\/p>\n

RAKIA subsequently breached various court orders, including\u00a0by failing\u00a0to provide disclosure and to put forward a defence.\u00a0On application from Mr Azima, by an Order dated 3 October 2023, the\u00a0English\u00a0High Court entered judgment\u00a0against RAKIA\u00a0and\u00a0awarded Mr Azima indemnity\u00a0costs\u00a0and interest\u00a0worth\u00a0approximately \u00a38.9 million.<\/p>\n

RAKIA has failed to make any payment to Mr Azima and remains in breach of the October 2023 Order. Mr Azima is therefore taking enforcement action in Georgia and worldwide to prevent RAKIA from disposing of its assets. S<\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
